Terms of Service

1. Agreement to Terms

These Terms of Service ("Terms") constitute a legally binding agreement between you ("User," "you," or "your") and YOURDRAFT AI LTD, trading as YourTrack ("Company," "we," "our," or "us"), Company No. 16191703, governing your access to and use of the YourTrack platform, website, and related services (collectively, the "Service").

By accessing or using the Service, you agree to be bound by these Terms. If you do not agree to these Terms, you may not access or use the Service.

2. Description of Service

YourTrack is a logistics tracking and management platform that enables users to:

• Create customizable tracking portals for clients
• Connect email accounts to automatically extract shipment information
• Manage shipment data, documents, and timeline events
• Share real-time tracking updates with clients
• Automate logistics workflow processes

3. Account Registration

3.1 Eligibility

You must be at least 18 years old and have the legal capacity to enter into contracts to use the Service. By registering, you represent that you meet these requirements.

3.2 Account Security

You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to:

• Provide accurate and complete registration information
• Keep your password secure and confidential
• Notify us immediately of any unauthorized access
• Accept responsibility for all activities under your account

4. Email Integration

The Service allows you to connect third-party email accounts (Gmail, Outlook, or IMAP servers) to automate logistics data extraction. By connecting an email account:

• You authorize us to access and read emails from the connected account
• You confirm you have the authority to grant such access
• You understand that we will process emails to identify logistics-related content
• You acknowledge that email processing is automated and may not be 100% accurate

You may disconnect your email account at any time through the Settings page. Upon disconnection, we will delete all stored email data associated with that connection.

5. Acceptable Use

You agree not to use the Service to:

• Violate any applicable laws or regulations
• Infringe on the intellectual property rights of others
• Upload malicious code, viruses, or harmful content
• Attempt to gain unauthorized access to our systems
• Interfere with the proper functioning of the Service
• Use the Service for fraudulent or deceptive purposes
• Resell or redistribute the Service without authorization
• Harvest or collect user data without consent
• Use automated systems to access the Service in a manner that exceeds reasonable use

6. User Content

6.1 Ownership

You retain ownership of all content you submit to the Service, including shipment data, documents, and other materials ("User Content"). By submitting User Content, you grant us a non-exclusive, worldwide, royalty-free license to use, store, and process such content to provide the Service.

6.2 Responsibility

You are solely responsible for the accuracy, legality, and appropriateness of User Content. You represent that you have all necessary rights to submit such content.

7. Intellectual Property

The Service, including its design, features, code, and content (excluding User Content), is owned by YOURDRAFT AI LTD and protected by intellectual property laws. You may not:

• Copy, modify, or distribute the Service
• Reverse engineer or attempt to extract source code
• Use our trademarks without written permission
• Create derivative works based on the Service

8. Third-Party Services

The Service integrates with third-party services (e.g., Google, Microsoft) subject to their own terms and policies. Your use of these integrations is also governed by the respective third-party terms. We are not responsible for third-party services or their availability.

9. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, INCLUDING:

• MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE
• ACCURACY OR RELIABILITY OF AUTOMATED DATA EXTRACTION
• UNINTERRUPTED OR ERROR-FREE SERVICE
• SECURITY OR INTEGRITY OF DATA

We do not guarantee that logistics data extracted from emails will be accurate or complete. You should verify all automated updates before relying on them for business decisions.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, YOURDRAFT AI LTD SHALL NOT BE LIABLE FOR:

• INDIRECT, INCIDENTAL, SPECIAL, OR CONSEQUENTIAL DAMAGES
• LOSS OF PROFITS, DATA, OR BUSINESS OPPORTUNITIES
• DAMAGES ARISING FROM INACCURATE DATA EXTRACTION
• SERVICE INTERRUPTIONS OR DOWNTIME

OUR TOTAL LIABILITY FOR ANY CLAIMS ARISING FROM YOUR USE OF THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR ONE HUNDRED POUNDS (£100), WHICHEVER IS GREATER.

11. Indemnification

You agree to indemnify, defend, and hold harmless YOURDRAFT AI LTD, its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including legal fees) arising from:

• Your use of the Service
• Your User Content
• Your violation of these Terms
• Your violation of any third-party rights

12. Termination

We may suspend or terminate your access to the Service at any time, with or without cause, with or without notice. You may terminate your account at any time by contacting us or using account deletion features.

Upon termination, your right to use the Service ceases immediately. Provisions that by their nature should survive termination will survive, including intellectual property, disclaimers, limitations of liability, and indemnification.

13. Modifications to Terms

We reserve the right to modify these Terms at any time. We will notify you of material changes by posting the updated Terms on this page and updating the "Last updated" date. Your continued use of the Service after changes constitutes acceptance of the modified Terms.

14. Governing Law

These Terms are governed by and construed in accordance with the laws of England and Wales. Any disputes arising from these Terms or your use of the Service shall be subject to the exclusive jurisdiction of the courts of England and Wales.

15. Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect. The unenforceable provision will be modified to the minimum extent necessary to make it enforceable.

16. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and YOURDRAFT AI LTD regarding the Service and supersede all prior agreements and understandings.
